ATAP is optional in New York — and it is worth money anyway
Does New York require server training?
No. The Alcohol Training Awareness Program is voluntary; the State Liquor Authority recommends that all licensees and employees who serve or sell alcohol take one, but no law forces it.
What does an ATAP certificate actually buy?
Two concrete protections. If a licensee or server is charged with serving an underage or visibly intoxicated person, the licensee has a clean disciplinary record for at least five years, and the person holds a valid ATAP certificate of completion, the civil penalty for that offence is capped at 1,000 dollars. Separately, on a charge of Unlawfully Dealing with a Child in the First Degree — absent a conviction for the same in the previous five years — a valid ATAP certificate supports an affirmative defence, and the court may grant a reasonable adjournment to obtain one.
Is there one ATAP or several?
Two tracks. The SLA runs a separate programme for off-premises licensees and their employees and another for on-premises licensees and their employees, because the risks differ — a bodega counter and a Brooklyn cocktail bar fail in different ways.
Where does this course sit?
The penalty cap and the affirmative defence attach to a certificate from an SLA-certified ATAP school, and Certification Experts is not on that list. This course is responsible-service education: the carding habits, the altered-ID tells, the behavioural read on impairment and the refusal language that make the protections unnecessary in the first place.
